1. Acceptance of Terms

By accessing or using badart.io (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all visitors, waitlist subscribers, and registered users.

2. Description of Service

badart.io is a platform for independent artists to create and share 3D virtual galleries, sell framed prints of their artwork, participate in weekly art contests, and connect with a global creative community. Certain features may be unavailable during our beta period.

3. Accounts and Eligibility

• You must be at least 16 years old to use the Platform.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information when creating an account.

4. User Content

You retain ownership of the artwork and content you upload to the Platform ("User Content"). By uploading content, you grant badart.io a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform.

You represent and warrant that:

• You own or have the right to share all content you upload.
• Your content does not infringe any third-party intellectual property rights.
• Your content does not violate any applicable law or these Terms.

5. Prohibited Conduct

You agree not to:

• Upload content that is illegal, defamatory, harassing, or obscene.
• Infringe the intellectual property rights of others.
• Use the Platform to spam, phish, or distribute malware.
• Attempt to gain unauthorized access to any part of the Platform.
• Use automated tools to scrape or harvest data from the Platform without permission.
• Impersonate another person or entity.

6. Contests

Weekly art contests are subject to additional rules published at the time of each contest. Participation constitutes acceptance of those rules. badart.io reserves the right to disqualify entries that violate these Terms or contest-specific rules. Contest prizes and featured placements are determined at our sole discretion.

7. Print Sales

When you sell framed prints through the Platform, badart.io acts as a facilitator. You are responsible for ensuring you have the rights to sell reproductions of your work. badart.io will deduct a service fee from each sale; the current fee schedule is disclosed in your account settings. All sales are final unless a product arrives damaged or defective.

8. Intellectual Property

The badart.io name, logo, and all Platform software, design, and features are the exclusive property of badart.io and are protected by copyright and trademark law. You may not use them without our prior written consent.

9. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components. We are not responsible for the content uploaded by other users.

10. Limitation of Liability

To the maximum extent permitted by law, badart.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the past twelve months.

11. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Sections that by their nature should survive termination will continue to apply.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Platform. Continued use after the effective date of changes constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which badart.io is incorporated, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
